Germany&#8217;s Helaba Bank and Chicago-based  lender Capri Capital Partners are facing a $20 million lawsuit from investor Amir Chaluts at the troubled  <a href="http://therealdeal.com/newyork/articles/reade57-gearing-up-to-launch-in-tribeca-with-slightly-lower-than-average-prices">Reade57</a> condominium project in Tribeca, seeking to stop the lenders from modifying a loan agreement with the John Buck Co., the lead developer on the project. </p>
<p>
Chaluts, operating under the name 281 Broadway Developers at the project, filed suit in Manhattan Supreme Court June 24 seeking an injunction against the lenders for making a loan agreement without his consent and a judgment against the lenders.
</p>
<p>
&#8220;Despite developers having advised Helaba and Capri that any loan modification must be approved by developers, Helaba continues to fund the loan, and… Helaba, Capri and Buck are presently negotiating a modification of the loan agreements,&#8221; attorney Aaron Abraham, representing Chaluts, said in the New York state Supreme Court complaint.
</p>
<p>
Chicago-based real estate investor John A. Buck, chairman and CEO of his eponymous company, and Chaluts entered a deal in 2005 to develop the mixed-use condo project at 281 Broadway between Reade and Chambers streets. The project was slated to cost $94 million and open in August 2007. Under the financing agreements, Helaba agreed to an $84.7 million construction loan and Capri agreed to an $8 million mezzanine loan.

<p>
&#8220;From the very beginning of the project, Buck, who has been responsible for the management of the construction process, has mismanaged the project, leading to extreme delays and significant increased costs on the project,&#8221; Abraham wrote in the complaint.
</p>
<p>
A prior Supreme Court suit, filed in 2010,  accuses Buck of gross negligence, breaches of fiduciary duty and violations of the partners&#8217; operating agreement. Buck, who developed the Standard Hotel in the Meatpacking District, did not return calls for comment.
</p>
<p>
Court records show that a contractor hired by Buck in 2006 caused a landmark cast iron building at 287 Broadway to lean eight inches forcing the Department of Buildings to issue a vacate order, and then bring the Reade57developers in for regular updates on the progress of the condo project. The Reade57 project, designed by SLCE Artchitects, was <a href="http://therealdeal.com/newyork/articles/new-developments-cause-collateral-damage-to-neighbors">planned to form an L shape around 287 Broadway</a>.  </p>
<p>
In 2008, Chaluts rejected a request from Buck for additional funds to help maintain the project, which he says is his right under the operating agreement, according to legal documents obtained by <i>The Real Deal</i>. He said Helaba has been in talks on another modification of the loan agreement since the spring of 2010. The projected budget for the project has since ballooned to $125 million and Chaluts filed suit against Buck in 2010, challenging their authority to make unilateral decisions on the project.

<p>
Chaluts alleged in his 2010 suit that Buck refused to let him see the records or be consulted on decisions involving the loan modifications or other issues. Sales were previously <a href="http://therealdeal.com/newyork/articles/prices-set-at-reade57-with-john-buck-development-and-brown-harris-stevens-with-sales-to-launch-this-spring">scheduled to launch this spring</a>, with units ranging from $814,000 to $2.49 million.  </p>
<p>
Helaba and Capri officials were not immediately available for comment. Chaluts did not return calls seeking comment. </p>

<h2><span>Manhattan sales market continues to stabilize</span></h2>

<p>The Manhattan real estate sales market can best be characterized as stable, according to second-quarter reports issued by the city&#8217;s largest real estate brokerages, signaling strength amidst an uncertain economic climate elsewhere in the country. Reports from Prudential Douglas Elliman, the Corcoran Group and data from sister firms Halstead Property and Brown Harris Stevens show mixed but healthy indicators. In a still strict lending environment, it comes as little surprise that the best performing sectors of the market &#8212; the top end of the market where buyers are wealthiest, and the bottom end of the new development market where units qualify for Federal Housing Authority-approved loans &#8212; were those where financing came easiest. </p>
<p>
Though some year-over-year numbers were skewed because of the looming expiration of the homebuyer&#8217;s tax credit, which was slated to expire June 30, 2010 before a three-month extension was enacted, the firms&#8217; experts said much of the remaining variance can be explained by normal statistical fluctuation.
 </p>
<p>
According to Elliman&#8217;s report, the median sales price rose 8.7 percent over the first quarter to $850,000, but dropped 5.5 percent from the same period a year ago. The volume of sales spiked 10.7 percent to 2,650 from the first quarter, but dipped 3.8 percent year-over-year &#8212; a solid standing considering the looming expiration of the homebuyer&#8217;s tax credit, according to appraiser Jonathan Miller of Miller Samuel, who prepared Elliman&#8217;s report.
</p>
<p>
&#8220;The market is stable,&#8221; he said. &#8220;The key indicators were mixed, but consistent with long-term historical trends.&#8221;
</p>
<p>
For example, even though Elliman&#8217;s report shows the average listing remained on the market for 132 days, a 29.5 percent year-over-year increase, it&#8217;s actually consistent with the 10-year average Miller calculated of 127 days. The number was deflated in the second quarter of 2010 because buyers rushed to sign in time to qualify for the tax credit.
</p>
<p>
The big sore spot in the market was the median sales price of new developments, which plunged 15.7 percent from last quarter, and 19 percent from the year before, to $1.13 million. Miller said this was consistent with the fact that the average sale in a new development was about 15 percent smaller in physical size than previous quarters. Those smaller units require buyers to borrow less, and have price points that qualify for special loans, and therefore dominated the market, Miller said.

Still, according to identical market reports issued by Halstead and BHS, both part of Terra Holdings, the average price per square foot of a unit in a new Manhattan development fell 9 percent in the second quarter to $1,069.
</p>
<p>
&#8220;Many new units developed a few years ago were priced aggressively for that market,&#8221; Jim Gricar, general sales manager at Halstead, said. &#8220;Now, in many cases, the market has caught up to them.&#8221;
</p>
<p>
The Halstead and BHS reports show a 1 percent decline in the median price of a Manhattan home, to $835,000, compared to the same period a year ago. But the average apartment price rose 4 percent over that same period, and across all Manhattan neighborhoods those gains were powered by apartments with three or more bedrooms. In particular, on the Upper East and Upper West sides, units with three-plus bedrooms accounted for more than a fifth of all sales, and average prices roses 15 and 19 percent, respectively, over the prior year quarter.

&#8220;Buyers with the means to buy at the upper end of the New York market are, in fact, buying,&#8221; Gricar said. &#8220;They&#8217;re helping out the rest of the market.&#8221;

They&#8217;ve returned to the market, Gricar and Miller both said, now that prices have shown stability.

Corcoran&#8217;s report corroborated many of the aforementioned findings. Its report shows a median sales price of $830,000, a 4 percent increase over last quarter, and 6 percent greater than the same period a year ago. Though sales volume was down 14 percent versus the artificially high rate of the second quarter of 2010, at 3,180 sales it was down just 7 percent from the trailing five-year average, according to the report.

The median price of new development sales was $979,000, 15 percent less than last quarter, and 20 percent off the median price achieved a year ago. While the luxury end of the market posted modest price gains over last year, it actually declined somewhat from last quarter, when a single $48 million transaction heavily impacted the figures. However, re-sale co-ops posted a median sales price of $4.35 million, 18 percent above last year&#8217;s price, which the report attributes to growth in sales greater than $9 million.

<p>The river was not high, so there was not more <a href="http://www.templatic.com">than a two or three mile current</a>. Hardly a word was<br />
said<strong> during the next three-quarters of</strong> an hour. Now the raft was passing before the distant town. Two or three glimmering lights showed where it lay, peacefully sleeping, beyond the <em>vague vast sweep</em> of star-gemmed water, unconscious of the <span style="text-decoration: underline;">tremendous</span> event that was happening.</p>

<li>The <strong>Black Avenger</strong> stood still with folded arms, &#8220;looking his last&#8221; upon</li>
<li>the scene of his former joys and his later sufferings, and wishing</li>
<li>&#8220;she&#8221; <em>could see him now</em>, abroad on the wild sea, facing peril and death with dauntless heart, going to his doom with a grim smile on his lips. It was but a small strain on his imagination to remove Jacksons Island</li>
<li>beyond eyeshot of the village, and so he &#8220;looked his last&#8221; with a</li>
<li>broken and satisfied heart. <span style="text-decoration: underline;">The other pirates</span> were looking their last,</li>
<li>too; and they all <a href="#">looked</a> so long that they came near letting the</li>
</ul>
<p>current drift them out of the range of the island. But they discovered the danger in time, and made shift to avert it. About two oclock in the morning the raft grounded on the bar two hundred yards above the head of the island, and they waded back and forth until they had landed their freight.</p>
<p style="text-align: center;">Part of the little rafts belongings consisted of an old sail, and this they spread over a nook in the bushes for a tent to shelter their provisions; but they themselves would sleep in the open air in good weather, as became outlaws.</p>
<ol>
<li>They built a fire against the side of a great log twenty or thirty</li>
<li>steps within the sombre depths of the forest, and then cooked some</li>
<li>bacon in the frying-pan for supper, and used up half of the corn &#8220;pone&#8221;</li>
<li>stock they had brought. It seemed glorious sport to be feasting in that</li>
<li>wild, free way in the virgin forest of an unexplored and uninhabited</li>
<li>island, far from the haunts of men, and they said they never would</li>
<li>return to civilization. The climbing fire lit up their faces and threw</li>
<li>its ruddy glare upon the pillared tree-trunks of their forest temple,</li>
<li>and upon the varnished foliage and festooning vines.</li>
</ol>
<p>When the last crisp slice of bacon was gone, and the last allowance of corn pone devoured, the boys stretched themselves out on the grass, filled with contentment. They could have found a cooler place, but they would not deny themselves such a romantic feature as the roasting camp-fire.</p>
